A homeowners' association (HOA) is a non-profit corporation registered with the state and managed by a duly elected Board of Directors. Its purpose is to maintain all common areas and to govern the community in accordance with the legal documents, including the CC&Rs, Bylaws, and Articles of Incorporation. Membership is both automatic and mandatory.

A management company is contracted by the Board of Directors to provide services such as:
Collection of assessments
Supervision of subcontractors
Obtaining bids for subcontracted services
Providing financial statements and collection reports
Acting as a communication liaison between homeowners and the Board

The Covenants, Conditions, and Restrictions (CC&Rs) are legal documents that outline the operational guidelines for the community. They are recorded with the County Recorder’s Office and included in the title to your property. Failure to abide by the CC&Rs may result in a fine.

The Bylaws are guidelines for the operation of the non-profit corporation. They define:
Duties of Board officers
Terms of Directors
Membership voting rights
Required meetings and notices
Rules necessary to run the association

The Board of Directors is a governing body responsible for overseeing the HOA’s business. Board members are elected by homeowners or as specified in the Bylaws. Their limitations and responsibilities are outlined in the governing documents.

Yes. In addition to CC&Rs, most associations adopt Rules and Regulations for:
Parking policies
Pets
Pool use hours
Architectural guidelines for exterior modifications
Rules ensure aesthetic integrity and property value. Violations may result in fines.

Yes. Notices of regular Board meetings are published in the community newsletter and posted on the Calendar page of the website.

Assessments are mandatory payments from homeowners to cover:
Maintenance of common areas
Reserve funds for future repairs and replacements
Assessments are due on the first day of each month.

The initial budget is set by the developer based on:
Utilities
Landscaping
Administration costs
Reserve funds are allocated for future expenses like street resurfacing or pool equipment replacement. These budgets are later adjusted by the Board of Directors.

The Civil Code allows for annual increases, but generally not exceeding 20% per year without homeowner approval. The Board of Directors may raise assessments to cover rising maintenance costs.

Timely payment is required to sustain community services.
